Yesterday, after years of litigation by persons suffering abdominal injuries and repeat surgeries a Jury in Rhode Island brought back the first money verdict against the manufacturer Davol, Inc and C. R. Bard for one and a half million dollars yesterday. There had been one prior trial earlier this spring where a jury found the company was negligent in the design of the hernia patch but concluded that it did not cause the continuing medical problems of the patient.
Davol and C.R. Bard annouced three separate recalls of the abdominal kugel hernia patches between 2005 and 2007 but have refused to enter into reasonable settlements with the injured victims. Perhaps now that this jury has spoken the company will address the damage that it has done. Otherwise, I expect that the trials will continue and we will see more million dollar verdicts against these companies.
