A Galveston man has filed suit against his insurer claiming that the company failed to honor his underinsured motorist coverage after he was involved in a multi vehicle accident involving a semi truck.

The plaintiff, Dennis Kroll claims that he suffered over $200,000 in damages when he was rear-ended on the morning of November 23, 2009 by a man driving a Peterbuilt tractor trailer. Kroll claims that the impact was so great that it causes the seat belt in his 2004 Ford f-150 to break lose.

The impact also forced Kroll’s truck to collide with the vehicle in front of him, causing even greater injuries to his neck left leg and shoulders, according to the original petition.

"Thereafter, defendant Farmers made a request for additional information and documents to which plaintiff Kroll fully and timely responded to enable defendant Farmers to secure final proof of loss for plaintiff Kroll’s claim," the suit says.

According to the suit Farmers has yet to pay the damages that Kroll is entitled to despite being provided the documents reasonably necessary to evaluate Kroll’s claim.

The case has been assigned to Galveston County 212th District Court under Judge Susan Criss
