Distracted driving can kill. When you’ve been hit by another driver, it can be the most devastating moment in your life. You may have trouble sleeping remembering what happened.

In this short blog article I’m going to explain a little bit about what distracted driving is and what can be done.

First of all, Distracted driving is against the law in Nebraska.

As a Nebraska injury lawyer I have seen lives lost from distracted driving. There are many ways that someone can become distracted behind the wheel, the most publicized of course, is texting, but there are other ways to end up in an accident when distracted. Here are some other ways drivers become distracted:

  • Brushing hair
  • Putting on make up
  • Looking for something on the floor of the car
  • Children can distract the driver
  • Eating
  • Texting

Proving that someone was doing any of these things can be tricky. If you suspect this happened the first thing you will want to do is ask the other driver. Their admission is evidence that can often be used in your case. This is called “Admission of guilt”.  Take pictures of the scene of the accident. Investigators are trained to find things you may not even be noticing.  And be sure to check and see if there are any witnesses and get their information. If you can get a video statement from them on your cell phone that will also be very powerful later.
